What Matters Are Covered Under Family Law

Family laws are the section of laws dealing with legal issues connecting with family matters and domestic relations. Such legal issues may violence/abuse, divorce, separation, maintenance, mediation, guardianship, custody, access, and more.  The other names of family law are matrimonial law or the law of domestic relations.

Domestic abuse: Most common issue is domestic abuse. A family member may be abused physically, sexually, psychologically, emotionally, or financially by another family member within the family. Integrating the law on domestic violence, The Domestic Violence Act 2018 provides additional protections for victims of domestic violence and. 

Children guardianship: The rights and duties of parents regarding bringing up their children is guardianship. The day-to-day care, residency, and upbringing of children are called custody. Only the dependent children under the age of 18 are eligible to consider in custody matters. In the cases of divorce, one parent is selected for custody of children and the other is allowed to access their children at the agreed time. 

Access: The children who do not reside with the parent can stay overnight off and on, on alternate weekends or during holidays means Access.

Maintenance: The dependent children have legal rights to their parents while they are married or unmarried to get responsibility to maintain themselves. Spouses/civil partners must maintain each other as per their affordability. If the parties can deny taking responsibility for maintenance, either party can apply to a court to get a maintenance order.

In order to get a parent or legal guardian, an applicant can apply to the court if a parent/guardian denies being a signatory person in a passport application on behalf of a child.

Divorce: The major part of family law is the decree of divorce. The court grants the decree of divorce if the applicant met the required conditions. In case of the decree of divorce, the court may also make various orders such as maintenance payment, lump sums payment, property transfer, the extinguishment of succession rights, pension rights, custody of children, access to children, and other matters.

Judicial separation: the court may grant a decree of judicial separation when a couple cannot agree to live separately. Either party of the couple can apply to the court for judicial separation. By decreeing, a court confirms to not living together as a married couple. The court sometimes orders custody of and access to children.

Mediation: Couples who are trying to resolve their disputed issues of custody of, and access to children, maintenance, and property rights, get benefit from mediation. It is not marriage counseling. The mediator fined a mutually acceptable arrangement and co-operation with each other in their work by encouraging a couple naturally. Mediation includes any separating couples whether they are married or not even a same-sex couple.

Nullity of marriage: A legal declaration by which a court cancels the marriage that two people have gone through a marriage ceremony is Nullity of marriage. In the eyes of the law or the State, these types of marriage never actually existed.

Nullity of civil partnership: although two people have gone through a civil partnership ceremony, the civil partnership is not valid in the eyes of the law of the State. a legal declaration by a court declares that such kinds of civil partnerships are null and void.

Paternity and parentage declaration: paternity dispute arises when a father without marriage the mother of children does not acknowledge their children. Many children are not named with paternity on the birth certificate. The parent may need to prove paternity in quest of applying for guardianship, custody, or access to their children.
